Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the NorthStone Landscaping website, forms, lead-referral services, and related services (collectively, the “Services”).

By accessing our website or submitting a request through our Services, you acknowledge that you have read and understood these Terms.

1. About NorthStone Landscaping

NorthStone Landscaping (“NorthStone,” “we,” “us,” or “our”) operates a landscaping lead-generation and referral service serving areas including Burlington, Hamilton, Mississauga, Oakville, and surrounding communities in Ontario.

NorthStone does not itself perform the landscaping work referred through the Service.

NorthStone collects information from individuals interested in landscaping services and may connect those individuals with independent local landscaping contractors that may be interested in performing the requested work.

NorthStone may receive compensation or a referral/service fee in connection with leads or projects referred to contractors.

2. Independent Landscaping Contractors

Landscaping contractors receiving leads through NorthStone are independent businesses and are not employees of NorthStone.

Unless expressly stated otherwise in writing, NorthStone does not employ, supervise, direct, or control the contractors' performance of landscaping work.

Contractors are responsible for maintaining their own applicable business registrations, licences, insurance, WSIB coverage or documentation where applicable, equipment, personnel, and other requirements associated with their businesses.

NorthStone seeks to work with appropriately insured contractors; however, customers should independently evaluate a contractor before entering into an agreement with that contractor.

3. NorthStone Is a Referral Service

Submitting a project request to NorthStone does not mean that NorthStone has agreed to perform landscaping services for you.

NorthStone's role is primarily to receive and analyze project requests, identify potentially suitable independent contractors, and refer or provide those opportunities to contractors.

When you submit a request, information relating to your request may therefore be disclosed to one or more independent landscaping contractors so that they can evaluate the opportunity and potentially contact you.

The contractor performing the work is responsible for the landscaping services it agrees to provide.

Any scope of work, pricing, scheduling, warranties, guarantees, payment arrangements, changes to a project, or other terms relating to the actual landscaping work should be established between you and the applicable contractor, unless NorthStone expressly states otherwise in writing.

4. Project Requests and Leads

When submitting a project request, you agree to provide information that is accurate to the best of your knowledge.

Information you submit may include your:

  • Name;
  • Phone number;
  • Email address;
  • Property or project location;
  • Requested landscaping services;
  • Project description;
  • Photos or other materials you voluntarily provide;
  • Preferred timing;
  • Budget information, if requested; and
  • Other information relevant to evaluating your landscaping project.

Submitting a project request does not guarantee that a contractor will accept the project, contact you, provide an estimate, or perform any services.

5. Sharing Project Information With Contractors

A fundamental part of the NorthStone Service is connecting prospective customers with independent landscaping contractors.

By requesting that NorthStone connect you with landscaping providers, you authorize NorthStone to disclose information reasonably necessary to facilitate that request—including your name, contact information, project location and project details—to independent contractors who may be able to service your project.

Those contractors are separate businesses. Their handling of personal information may also be governed by their own privacy practices and legal obligations.

NorthStone may receive compensation from contractors in connection with referred leads or completed projects.

6. Estimates and Pricing

Information or preliminary pricing presented through the website should not be considered a binding landscaping contract unless expressly identified as such.

Final pricing may depend on property conditions, measurements, materials, accessibility, project complexity, site inspections, and other factors.

The independent contractor accepting a project is responsible for establishing the terms governing the landscaping work with the customer.

7. Communications About Your Request

If you provide a telephone number, email address, or other contact information while requesting landscaping services, NorthStone and, where applicable, the independent contractor(s) to whom your request is referred may contact you as reasonably necessary to respond to and administer your request.

This can include communications regarding your project, estimates, scheduling, questions about your request, contractor matching, and follow-up regarding the services you requested.

Communications will be made subject to applicable Canadian communications and privacy laws.

8. Marketing Communications

Where required by law, NorthStone will separately request consent before sending promotional or marketing electronic messages.

If you expressly opt in to receive marketing communications, NorthStone may contact you regarding relevant services, promotions, offers, or future landscaping opportunities, subject to applicable law.

You may withdraw consent to receive commercial electronic messages through the unsubscribe method provided in the communication or by contacting NorthStone.

Withdrawing marketing consent does not necessarily prevent communications reasonably necessary to respond to or administer an existing project request.

9. Contractor Selection

NorthStone may consider factors such as service area, project type, availability, and contractor capabilities when referring a project.

A referral does not constitute a guarantee, certification, or warranty regarding a contractor.

Customers are responsible for deciding whether to engage a contractor and should ask any questions they consider appropriate regarding insurance, experience, qualifications, pricing, warranties, and the proposed scope of work before proceeding.

10. Contractor Services

Because independent contractors perform the landscaping services, issues concerning the actual performance of those services—including workmanship, project completion, property damage, delays, warranties, materials, or disagreements concerning the scope of work—may ultimately need to be addressed with the contractor that performed the services.

Nothing in these Terms is intended to exclude or restrict liability or consumer rights where doing so would be prohibited by applicable law.

11. No Guaranteed Results

NorthStone does not guarantee that:

  • a contractor will be available for a particular project;
  • a contractor will accept a project;
  • a particular price or estimate will be offered;
  • services will be available within a particular timeframe; or
  • a customer's landscaping objectives will be achievable.

12. Website Information

NorthStone attempts to maintain accurate information on its website but does not guarantee that every description, price, service area, availability statement, or other piece of website information will always be complete or current.

Website content may be updated without notice.

13. Acceptable Use

You may not misuse the website, attempt to interfere with its operation, submit intentionally false or fraudulent project requests, impersonate another person, introduce malicious software, scrape the website in violation of applicable law, or use the Services for unlawful purposes.

14. Intellectual Property

Unless otherwise indicated, NorthStone's website content, branding, graphics, logos, designs, and original written materials are owned by or licensed to NorthStone and may not be reproduced or commercially exploited without permission, except as permitted by applicable law.

15. Third-Party Services

The website may use third-party providers for services such as website hosting, analytics, communications, form processing, scheduling, or other business functions.

NorthStone is not responsible for unrelated third-party websites that may be linked from the website.

16. Limitation of Liability

To the maximum extent permitted by applicable law, NorthStone will not be responsible for indirect, incidental, special, or consequential losses resulting from use of the website or referral service.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

Because legal limitations of liability can depend heavily on the circumstances and applicable consumer-protection laws, this provision should be read subject to all applicable laws.

17. Privacy

Personal information collected through the Services is handled according to the NorthStone Landscaping Privacy Policy and applicable privacy law.

18. Changes to These Terms

NorthStone may update these Terms from time to time. The updated version will be posted on the website with a revised “Last Updated” date.

Where applicable law requires additional notice or consent for a particular change, NorthStone will take the steps required by law.

19. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without limiting any rights that cannot lawfully be waived or restricted.
